A lawyer for New York counsel General Letitia James wrote to the president-elect’s counsel on Tuesday, claiming that Donald Trump’s impending inauguration as the next president has no bearing on his $454 million civil fraud verdict.
Following a court ruling last year that they routinely inflated Trump’s net worth to obtain better loan terms during a ten-year business history, Trump and his adult sons are now owed around $490 million, plus interest, in their civil fraud lawsuit. Trump has filed an appeal of the ruling.
According to the letter, James plans to defend her decision against Trump during his appeal since presidents are not immune from civil action.
In a letter to D. John Sauer, Trump’s appellate attorney and solicitor general nominee, New York Deputy Solicitor General Judith Vale stated that the typical responsibilities of civil litigation do not interfere with the President’s official duties in a manner that is unconstitutional under the U.S. Constitution.
Sauer requested James to drop her lawsuit against Trump last month in an effort to mend political tensions and improve the state of our nation.
President Trump has called for an end to our country’s political squabbling and for the opposing parties to cooperate for the greater good of the nation since his historic election victory. Referring to the recent dismissal of Trump’s federal election tampering and classified documents lawsuits, Sauer stated that this call for unity also applies to the legal onslaught on him and his family that has continued throughout the most recent election cycle.
“There is no merit to your claim that the pendency of defendants’ own appeal will impede Mr. Trump’s official duties as president,” Vale said in her letter, rejecting the move.
James is free to pursue her case when Trump is back in the White House since the New York attorney general’s complaint is civil.
Accordingly, Vale’s letter stated that the different actions taken by the New York County District Attorney’s Office or the Special Counsel’s office in the corresponding criminal proceedings initiated by those offices against Mr. Trump are not relevant in this matter.
A ruling on Trump’s appeal of the ruling might be made at any time.
