According to a decision made by a state court on Wednesday, the fact that a convicted murderer escaped from a Pennsylvania jail the previous year has resulted in him losing his right to appeal his initial life sentence.
During the time that Danilo Cavalcante was waiting to be transported to a state prison to serve a life term for the murder of his ex-girlfriend, he managed to gain escape from a lockup in Chester County.
After climbing over razor wire and jumping from a roof, he escaped from the prison by climbing up between two walls in the exercise yard of the place where he was being held.
Two weeks later, Cavalcante was apprehended following a ferocious manhunt that garnered widespread media attention across the country.
During the time that he was on the run, his legal team submitted a motion that contested the evidence as well as specific points of his sentence in the murder case.
On the other hand, the motion was deemed legally void due to the fact that the Pennsylvania Superior Court has stated that fugitives in the state of Pennsylvania lose such rights while they are on the chase.
The deadline for Cavalcante’s attorneys to appeal his life sentence without the possibility of parole for murder was consequently impacted as a result of this.
The period for filing an appeal would have been extended if the request had been allowed to proceed.
On the contrary, the initial deadline was not altered, and the court decided that Cavalcante’s subsequent appeal was filed eight days after the period had already passed.

A guilty plea to escape was entered by Cavalcante in August, and he was condemned to serve a penalty ranging from 15 to 30 years, in addition to his life sentence without the possibility of release.
