When the wheelchair-bound landlord in Wyoming attempted to evict the man from his rental property, the man was convicted guilty of killing him.
On Friday, a jury convicted Burdick Nelson Seminole of all charges. He was accused of first-degree murder of Michael Standing Elk. He was also found guilty of using a gun to kill someone and shooting a gun during a violent crime. The verdict was rendered after four days.
On August 8, 2023, Standing Elk evicted Seminole from the home he rented on the Wind River Indian Reservation because, according to court records from the Bureau of Indian Affairs, Seminole was bringing young ladies to the house to get high and using drugs. As a result, the landlord and tenant got into a fight.
After Seminole left, Standing Elk rented the house to other people, but Seminole returned to confront his former landlord for using derogatory language.
People who talked with the police said that Seminole entered Standing Elk’s property when he was in bed and started striking him in the head while urging him to stop talking. Standing Elk’s partner contacted the police as the altercation between the two guys grew more intense. Elk managed to climb out of bed and into his wheelchair while standing. The dispute in the living room proceeded according to plan.
But Elk, who was standing, was armed. He made fun of Standing Elk by saying, “You better make sure it’s loaded and better make sure you got f ammo,” Seminole told the police. He then pistol-whipped Standing Elk, according to the affidavit, and as he turned around, he heard a boom, but he was unaware of what had struck him.
Standing Elk is reported to have declared, “Okay, I’m done,” after his gun became jammed while he was attempting to shoot the Seminole. Burdick, I see you.
Witnesses reported that Seminole then shot Standing Elk. Seminole was shot by one of the other tenants who burst into the room. Seminole informed the police that his memory went blank at this point.
According to Cowboy State Daily, Seminole informed the police that he went back to Standing Elk’s house to confront him about smack talk and claimed that Standing Elk was threatening his daughter.
After one of the housemates shot him, he drove himself to the Wind River Family and Community Health Care clinic, where he was detained.
According to a police report, a black Springfield XDS gun was discovered in the front passenger seat of Seminole’s car. An agent at the scene overheard Seminole remark, “I shouldn’t have picked up that gun.”
On February 6, Seminole will receive a sentence. He might be sentenced to life in jail.
