Police in San Jose said in a news release that a man was killed when he was hit by a car on purpose on Monday.

At 5:03 a.m., SJPD officers were called to the area of North Capitol Avenue and Berryessa Road to investigate a hit-and-run accident involving a pedestrian.

They found an adult man pinned under a minivan who wasn’t breathing or awake when they got there.

Medical staff at the scene said the man was dead, according to the police.

The driver had already left the scene when the police arrived, the press release said. After looking into it, the police found that the man was hit on purpose and named the suspect as 40-year-old Edward Herrera from San Jose. Also, they found out that Herrera and the victim were friends.

On the same day, police found Herrera in San Jose and arrested him. For murder, he was booked into the Santa Clara County Main Jail.

According to the news release, the police have not yet figured out what happened or why it happened. This is the 27th murder in San Jose this year.

The Santa Clara County Coroner’s Office will say who the victim is as soon as they are sure they are who they say they are and have notified the next of kin.
