A father of two, who authorities say was purposefully hit and killed by a vehicle in San Jose, is recalled by family as a good-humored, giving man who spent time assisting the homeless.

Leroy Thomas, 32 years old, was hit near the corner of North Capitol Avenue and Berryessa Road around 5 a.m. on Monday, according to his family.

“After this, our hearts will never be the same,” Thomas’ sister Sabrina Thomas said.

When the police got there, they found a man pinned under a minivan who was not breathing or conscious. Later, Edward Herrera, a resident of San Jose, was arrested. He is suspected of driving drunk and killing someone, which was the city’s 27th murder of 2024.

Police said that their investigation showed that Herrera knew the victim and that the accident was planned. He was taken to the main jail in Santa Clara County on charges of murder.

Thomas’ sister said that she and no one else in the family knew Herrera. This makes it hard to guess why the hit-and-run happened.

Thomas has a 13-year-old son and a 9-year-old daughter. His family said that there would be a hole at the dinner table this holiday season without him.

“This year, Thanksgiving and Christmas will be different. It was always fun to spend time with my brother.

There we were, having dinner, like any normal family, having Thanksgiving dinner, and he was making jokes. He always told jokes. “He was a big goofy person, and we lost that,” Sabrina Thomas said.

The family said they were working on making funeral plans right now. To help cover the costs, a GoFundMe page has been set up. Thomas’ sister said that any extra money would be put into a trust for his two children.
